Codelco has acknowledged the decision by the Santiago Court of Appeals to accept a complaint against former Supreme Court Minister Ángela Vivanco. This decision allows the criminal investigation to proceed and, according to Codelco, “confirms the solidity of our arguments and the robustness of the evidence that together with the Public Prosecutor’s Office we have presented in different instances and hearings of the process.”
The company stated it has experienced substantial financial losses, totaling more than $17 billion. Codelco emphasized that this loss impacts not only its own assets but also those belonging to all Chileans. The legal action claims repeated irregularities, with court findings describing “serious and consistent evidence” that Vivanco intervened at several points in the process. The ruling notes unusual acceleration of resolutions that favored the Belaz Movitec Consortium.
Codelco reported it began addressing these irregularities after they were identified in 2023. Following recognition as a victim in an investigation initiated by the National Prosecutor in September 2024, Codelco said it has been actively involved by providing information, requesting investigative actions that led to important lines of inquiry, participating throughout every stage, pursuing appropriate legal measures, and cooperating with both prosecutors and relevant institutions.
“We have acted diligently and proactively,” Codelco stated regarding its response since becoming aware of potential misconduct.
